How to bring a Small Claims motion
This page is a public educational walkthrough. It is not a retainer, a court form, or a promise about your result. For legal advice, you should contact an appropriate Lawyer or Paralegal specializing in the area of law you need assistance with.
Use this only inside an existing Small Claims file
Starting the case is Form 7A. A motion asks for an order along the way: set aside default, amend a claim, or similar.
Fill Form 15A
In Small Claims the notice and the sworn facts are one form. Say the order you want, then swear the facts. Attach exhibits.
Serve Form 15A and file Form 8A
Bring stamped copies to the motion date plus the issued claim and defence.
If you were served with Form 15A
File an affidavit in response if you oppose it. Attend the date.
