How to respond to an ESA claim as an employer

This page is a public educational walkthrough. It is not a retainer, a court form, or a promise about your result. For legal advice, you should contact an appropriate Lawyer or Paralegal specializing in the area of law you need assistance with.

  1. Read the claim and the response deadline on the package

The officer works from documents. Silence can mean the claim is decided on the employee’s numbers.

  2. Pull payroll, timesheets and the written contract

Match each claimed period. If a period is wrong, say so in writing with the record attached.

  3. Respond through the channel the Ministry named

Do not rely on a text to the employee as your official response.

  4. Do not fire someone because they filed a claim

Reprisal is a separate Employment Standards issue.

  5. If an order to pay arrives, read the review deadline

That date is short. This page is not the order and not legal advice on whether to review.
