How to file an Employment Standards claim in Ontario

This page is a public educational walkthrough. It is not a retainer, a court form, or a promise about your result.

  1. See whether the ESA applies

Some jobs are federally regulated. Unionized workplaces may need a grievance first.

  2. List wages or leave you say are owed

    Dates and amounts first.

  3. File with the Ministry

There are time limits. Keep pay stubs.

  4. Read the ESA and OHSA pages

Safety issues may be a different statute.
