How to start an insurance claim file

This page is a public educational walkthrough. It is not a retainer, a court form, or a promise about your result. For legal advice, you should contact an appropriate Lawyer or Paralegal specializing in the area of law you need assistance with.

  1. Read the policy and the broker or company named on it

Auto, home and life use different statutes and different claim desks.

  2. Give written notice of the loss with the date and a claim number if they assign one

Phone notice plus an email is better than phone alone.

  3. Keep photos, estimates and the police or incident number if there is one

The insurer works from a file.

  4. A denial letter starts a new clock

Read whether they want more documents or are refusing coverage. Limitation periods for court claims are easy to miss.

  5. This site hosts insurance statutes, not your policy wording

The contract in your drawer still controls the claim.
