Accident benefits versus a lawsuit after a crash

This page is a public educational walkthrough. It is not a retainer, a court form, or a promise about your result. For legal advice, you should contact an appropriate Lawyer or Paralegal specializing in the area of law you need assistance with.

  1. SABS benefits are first-party

You claim them from an insurer. A tort lawsuit is about another person’s liability and uses Superior Court civil forms if it is filed.

  2. You can have both tracks

They still use different rules and different limitation ideas. Do not assume one date covers both.
