How to apply for a certificate of appointment

This page is a public educational walkthrough. It is not a retainer, a court form, or a promise about your result. For legal advice, you should contact an appropriate Lawyer or Paralegal specializing in the area of law you need assistance with.

  1. This is the court document many banks call probate

It is not the will. You apply in the Superior Court of Justice estate office.

  2. Open the current Rule 74 and 75 forms under Court Forms

Do not use last year’s kit.

  3. Bring the original will and a death certificate

File, pay the estate court fee or use fee waiver, then wait for the certificate.

  4. If someone is challenging the will

That is a different, urgent process. Get advice before you move assets.
