How to respond to a family application in Ontario

This page is a public educational walkthrough. It is not a retainer, a court form, or a promise about your result. For legal advice, you should contact an appropriate Lawyer or Paralegal specializing in the area of law you need assistance with.

  1. Read the form number and the court on the first page

Form 8 starts many family cases. A motion uses Form 14. The court name tells you whether this is OCJ, SCJ or Unified Family Court.

  2. Calendar the days to serve an answer

The Family Law Rules set the time to serve Form 10 or the answer named in the package. Missing it can mean the case moves without your evidence.

  3. Collect the documents the application talks about

Marriage certificate, existing orders, financial statements if support or property is claimed, and proof of service of anything you already filed.

  4. Serve and file the way the rules and the court location require

A Facebook message is not service. Keep affidavits of service.

  5. Official forms stay on ontariocourtforms.on.ca

Use the current Form 10 and financial statement for that court, linked from this site’s Court Forms page.
