How to start a Superior Court claim in Ontario
This page is a public educational walkthrough. It is not a retainer, a court form, or a promise about your result. For legal advice, you should contact an appropriate Lawyer or Paralegal specializing in the area of law you need assistance with.
Write the problem in one paragraph first
Who did what, when, how much money or what order you want, and why they are responsible.
Confirm this is not Small Claims or family court
Small Claims uses Form 7A and has a monetary limit. Family uses Form 8 / 8A. Superior Court civil claims use the Rules of Civil Procedure.
Download Form 4A, Form 14A, Form 4C and usually Form 14F
They are on the Rules of Civil Procedure list under Court Forms. A typical issued claim is that package, not a lone page.
Fill Form 14A in numbered paragraphs
Legal names, addresses for service, and a clear amount if you claim money.
Issue the claim and pay the fee or use fee waiver
The issued date starts later deadlines.
Serve each defendant and file proof of service
Then wait for Form 18A Statement of Defence or consider default next steps.
